Town of Lake Lure Updated Public Response Regarding Second Mountain, LLC

The Town of Lake Lure is providing the following update on the pending litigation with Second Mountain, LLC on 8/28/26 at 7:55 pm.  

Dozens of people attended the Lake Lure Town Council Work Session on Wednesday, August 26 to speak during public comment on the controversy around the lawsuits between Second Mountain and the Town of Lake Lure. Many of the speakers pled for a resolution to the ongoing dispute.

Toward the end of public comment, Commissioner Jim Proctor reiterated the Town’s position, which had been stated by Mayor Pritchett at the beginning of public comment period:

Commissioner Proctor: “If Second Mountain stops pursuing the boathouse and they adhere to their lease, that’s the solution.” Followed by Cara Brock nodding on camera and applause across the room. 

Paul Brock: “I’m happy to let the boathouse go, and we’ll do it. But we need to stop this litigation.”

SETTLEMENT AGREEMENT AND MUTUAL RELEASE

This Settlement Agreement and Mutual Release (“Agreement”) is entered into as of , 2026 by and between Second Mountain, LLC (“Second Mountain”) and the Town of Lake Lure, North Carolina (the “Town”). Second Mountain and the Town are referred to collectively as the “Parties.”

The Parties have agreed to resolve all claims contained in the above-captioned lawsuits pending in Rutherford County (File Nos.: 26CV000857-800 and 26CV001352-800) as follows:

1. Second Mountain shall abandon its claim that it is allowed to occupy the Police Boathouse located at 2662 MEMORIAL HWY, Lake Lure, Rutherford County, North Carolina (PIN: 1616938).

2. Second Mountain shall pay the Town all past due rent for the lease dated August 29, 2024, for 2654 Memorial Highway, Suite A, Lake Lure, Rutherford County, North Carolina (PIN: 1616937), which amounts to $3,218.00 on or before Monday, August 31, 2026. Second Mountain shall thereafter pay its rent on time, and the Parties shall abide by the terms of the lease.

This Agreement constitutes a full and final resolution of all claims, demands, damages, liabilities, causes of action, defenses, costs, expenses, and attorneys’ fees of every kind, whether known or unknown, suspected or unsuspected, arising out of or relating to the matters resolved herein.
